Terms of Service

What these terms cover

SendClipper is a service for sending email from your own verified domain, receiving replies into a mailbox, and testing mail in a sandbox before it reaches anyone. These terms are the agreement between you (and the company you sign up for) and us, Marseco SH.P.K. (Pristina, registration number 811367847), the company that runs SendClipper. They apply to the dashboard, the API and every other part of the service.

You accept them by ticking the box when you create an account. The Acceptable Use Policy is part of these terms: it says what you may and may not send, and it is the part we enforce most often.

Who can use SendClipper

  • SendClipper is a service for businesses: companies, organisations and people acting for their trade or profession. It is not offered to consumers for personal use, and by creating an account you confirm you are using it for business.
  • You must be old enough to enter into a binding contract where you live. If you sign up for a company, you confirm you are allowed to accept these terms on its behalf.

Your account and your team

  • Give us a real name and an email address you read. We send notices about your account (a paused workspace, a review decision) to the workspace Owner.
  • Keep your password, API keys and sandbox credentials secret. Anything sent with your credentials counts as sent by you, so revoke a key you think has leaked.
  • The person who creates a workspace is its Owner and answers for what the whole team sends from it, including people they invite.

New workspaces start in a sandbox

A new workspace can send up to 100 emails a day while it is in the sandbox. To leave it, verify a sending domain, arrange billing with us and accept these terms, then ask for a review from your dashboard. A person on our side reviews every workspace before the cap is lifted, and may ask you for something first; you will see their note on your dashboard and can ask again once it is addressed.

When we pause your sending

We can pause a workspace's sending, and we do so when mail from it harms the reputation every SendClipper sender shares:

  • Automatically, when the workspace's bounce or complaint rate reaches the level Amazon SES treats as critical (see the thresholds).
  • By hand, when we see mail that breaks the Acceptable Use Policy or receive a credible abuse report.

A paused workspace keeps its data, its dashboard and its mailbox; it only stops sending. The dashboard and every refused send say why. Sending resumes when we have reviewed it with you.

Your content and your data

  • What you send and receive stays yours. We process it to deliver, receive, store and show it to you, and to measure delivery and engagement (opens, clicks, bounces, complaints) for your dashboard, nothing else.
  • The body of a message you send is kept for 30 days by default and then deleted; the record that it was sent, and its delivery events, stay in your log.
  • You are responsible for having the right to email the people you email (see consent in the Acceptable Use Policy).
  • What we hold, for how long, and who else sees it is in the Privacy Policy.
  • By accepting these terms you also enter into our Data Processing Agreement, which governs the mail you send and receive through SendClipper (no separate signature needed).

Availability during the beta

SendClipper is in beta. We work to keep it running and your mail flowing, but we do not promise a particular uptime yet, and features may change as we learn.

Warranties and liability

SendClipper is provided as it is. We work to deliver every message, but delivery depends on other providers (the recipient's mail server, Amazon SES, the internet in between), so we cannot promise that a particular message is delivered, arrives on time, or lands in the inbox rather than in spam.

As far as the law allows, we are not liable for indirect or consequential loss (lost profits, lost revenue, lost data or harm to your reputation) arising from your use of SendClipper or from its being unavailable. Our total liability to you for everything arising from these terms is limited to the greater of €100 and the fees you paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms limits a liability that the law does not allow to be limited, such as liability for fraud or for harm caused deliberately.

The mail you send is your responsibility

If someone brings a claim against us because of mail you sent through SendClipper (because you had no right to email them, because the content broke the law or the Acceptable Use Policy, or because it infringed someone else's rights), you will cover our reasonable costs of dealing with it, including legal costs, and any amount we have to pay as a result.

Ending the agreement

You can stop using SendClipper at any time. We can suspend or close a workspace that breaks these terms or the Acceptable Use Policy, and we will tell the workspace Owner why.

Governing law

These terms, and any dispute about them, are governed by the law of the Republic of Kosovo. Disputes go to the competent courts of the Republic of Kosovo.

Changes to these terms

The version date at the top of this page is the version you accept. When we change the text, the date changes, everyone who signs up after that accepts the new version, and everyone already signed in is asked to accept it the next time they open the dashboard (their earlier acceptance stays on record). We record which version each person accepted and when, and we also email workspace owners about the change where we can deliver to them.
